Terms of Service

These Terms of Service govern the services provided by PresencePro Media, a 3Squared Media LLC brand based in Livonia, Michigan (“we,” “us,” “our”), to the restaurant or business that purchases them (“you,” “client”). By purchasing or using the service, you agree to these terms.

We provide a done-for-you seasonal “Predict the Final Score” football contest. Depending on the package you purchase, this includes:

• Weekly branded contest graphics delivered for you to post on your own pages — or done-for-you posting on the paid upgrade.
• A managed prediction page where fans submit their score predictions.
• Entry capture, with the entrant list delivered to you.
• Weekly winner selection and announcement support.

Each package covers one home team for one season. Adding another team or another season requires a separate purchase.

The service is sold for a single payment per season. There are no contracts and no auto-renewal — when the season ends, nothing renews unless you choose to buy again. Payment is due before the season setup begins unless we agree otherwise in writing.

A season package covers the regular season for your selected team. Playoff, postseason, bowl, or tournament weeks are not included and may be offered separately.

We work with one restaurant per game, per market. For the duration of your season, we will not run the same contest for another restaurant covering the same game in your market. Market boundaries are determined by us in good faith and confirmed with you before your season begins.

• You fund and fulfill all prizes and consolation offers. We do not supply or pay for prizes.
• Both the weekly winner's prize and any consolation offers expire at the end of the week they are issued.
• You are responsible for complying with all applicable contest, sweepstakes, gaming, alcohol, and advertising laws and platform rules, including any required official rules or disclosures.
• Contest entrants must be 18 or older.

Predict the Final Score is a marketing service. Results vary based on your market, your offers, your following, and your execution. We do not promise or guarantee any specific number of entries, customers, revenue, or other outcome.

• Provide timely access, approvals, brand assets, and offer details so we can launch and run the season.
• Post the weekly assets on schedule (unless you are on the done-for-you posting upgrade) and honor every prize and offer you advertise.
• Ensure you have the rights to any logos, photos, or content you give us to use.
• Do not use the service for anything unlawful, deceptive, or discriminatory, and do not resell or redistribute our materials without written permission.
• We retain ownership of our templates, systems, and processes; you receive a license to use the delivered assets for your own promotion.

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not control third-party platforms and are not responsible for their outages, policy changes, or account actions.

To the fullest extent permitted by law, our total liability arising out of or relating to the service will not exceed the amount you paid us for the season in question. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Either party may end the engagement in writing. Because the service is seasonal and delivered on a weekly schedule, fees for weeks already delivered are non-refundable. We may suspend or terminate the service immediately if you violate these terms, fail to pay, or use the service unlawfully.

We may update these terms from time to time. Updates apply going forward, and the effective date at the top of this page will be revised. The terms in effect when you purchased your season govern that season.

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Michigan.
